By John Ubaldi, “Ubaldi Reports”

One of the most famous speeches in all of U.S. history, one that was delivered after a bloody civil war that virtually tore the nation apart President Abraham Lincoln gave one of the most consequential and magnanimous inaugural addresses, on the need to bind the nation’s wounds. Unfortunately our political leaders today, failed to heed Lincoln’s counsel!

After a hotly contested presidential election where passions ran high on both sides, with President Biden emerging victorious and in his own inaugural address stated that he wanted to follow the example of Lincoln, but instead chose the path of confrontation and demagoguery.

This pursuit of violating our opponents has come full circle with the recent indictment of former President Donald Trump. Instead of the path Lincoln chose to follow after a bloody civil war, one that cost hundreds of thousands of lives on both sides, today partisanship is now the benchmark of todays elected officials.

Democrat progressive Manhattan District Attorney Alvin Bragg has finally did what no one in the entire history of the United States has done and that is to indict a former president of the U.S., and a current candidate for president.

Bragg is now fulling a campaign promise that he and New York State Attorney General Letitia Ann James had campaigned on and that is to get Donald Trump. Bragg has succeed at least in indicting Trump, but the jury is still out if he will eve rget a conviction let alone have it reach any type of court.

As of now we have not seen the text of the full indictment, but in the coming days we will. So far many constitutional legal scholars have stated this case is very weak and dubious at best. Many speculate this will be thrown out if it reaches a court of law.

Until the full text of the indictment is released in the coming days, we will not know what charges will brought beyond reviving a misdemeanor of allegedly falsifying a business document that had expired years ago and one which the statute of limitations had also expired.

If this is the only charge that Bragg is bringing to indict a former president he has brought one of the weakest cases that could be brought, many reports have suggested he may attempt to “bootstrap” the misdemeanor against Trump by elevating it to a felony. A felony charge has a much longer statute of limitations; this would be an effort by alleging the former president was trying to evade federal election charges.

Before Bragg indicted the Trump, the Department of Justice under Democratic Attorney General Merrick Garland and the Federal Election Commission all declined to indict as they believed no crime had been committed.

Bragg’s predecessor declined to prosecute.

Bragg himself declined to prosecute, which led to two of his prosecutors resigned in protest

Bragg himself declined to do so, and that led to two of his prosecutors resigned in protest. One of the prosecutors Mark F. Pomerantz then proceeded which was a highly unprofessional by writing a book on what he learned regarding the investigation, continued pursue a public campaign despite requests to stop.

The ongoing public pressure forced Bragg to concede and indict Trump

Many have stated that this looks to be politically motivated, why would Bragg move forward? Is he appealing to his progressive base who wants Trump in prison no matter the charge or the method it was accomplished.

Former Democratic Speaker of the House of Representatives Nancy Pelosi has inadvertently spoken for many Democrats stating in a Tweet, “No one is above the law, and everyone has the right to a trial to prove innocence,” she added. “Hopefully, the former President will peacefully respect the system, which grants him that right.”

I thought in our Constitutional Republic you are presumed innocent until proven guilty, Trump doesn’t have to prove his innocence; the government has to prove he is guilty.

Democrats seem to be euphoric over this indictment, but be careful for what you wish for.

Trump stirs passions on both sides, but one has to remember what one side does to the other will we replicated to the party out of power.  By indicting Trump, Bragg has opened the Pandora ’s Box which will not be easily closed.

Democrats have to remember they will not always be in power and once the Republicans take the executive branch could they do the same to President Biden, Hunter Biden and the entire Biden family over foreign business dealings?

Would a rouge conservative prosecutor bring indictments let’s say against President Biden and the entire Biden family once he is out of office over his families foreign business dealings?

The standard has now been set, and Trump is now the first former president to be indicted, but he will not be the last, this is something the nation should ponder is America to be known for persecuting your opponents. This happens in China, Russia, and Iran but not America; until now!

Again, why would Bragg bring such a weak case forward? Since this potential indictment was moving forward, no other crimes have been mentioned, so at this point we will have to wait until the full text of the indictment is made public for us to discover if other crimes have been included.

The strange part is that the Department of Justice failed and declined to prosecute the alleged federal election crime against Trump.

If history is any guide the Department of Justice tried to prosecute a case like this and they failed to get a conviction. One only has to remember how the DOJ tried to prosecute former Democratic presidential candidate John Edwards on stronger legal grounds then Trump and they failed.

The Edwards case was based campaign officials and donors who were directly involved in covering up an affair that produced a child. At the time Edwards had an affair while his wife was suffering from cancer, and still the prosecution failed to obtain a conviction.

Constitutional Legal Scholar at George Washington University Professor Jonathan Turley stated that the reason for the failure by the DOJ to obtain a conviction you need to show the sole purpose for paying hush money in such a scandal, because any married man, let alone a celebrity, there are various reasons to want to bury a sexual scandal.

Truly continued, For Trump, there was an upcoming election but he was also a married man allegedly involved in an affair with a porn star. He was also a television celebrity who is subject to the standard “morals clause” that’s triggered by criminal conduct or conduct that brings “public disrepute, scandal, or embarrassment.” These clauses are written broadly to protect the news organizations and their “brand.”

It seems Bragg and the Democrats are following the example of Russian Dictator’s Joseph Stalin’s Secret Police Chief Lavrentiy Beria who bragged that he could prove criminal conduct on anyone, even the innocent.  “Show me the man and I’ll show you the crime.”

Is this where America is heading, if it is we will regret ever going this way!
